BOMBAY HC PERMITS THE MUHARRAM RITUALS’ CONDUCT IN MAHARASHTRA ALLOWING ONLY 5 PEOPLE PRACTISING THE RITUAL

The order was passed by a Bench of justices – SJ Kathawalla and MV Jamdar with respect to a plea filed by the Shia’ite organisation, the All India Idaara-Tahafuz-E-Hussainiyat. The petitioners plead for the conduct of Muharram processions in a limited manner for two hours between 27th and 30th August.

The decision was taken by the Bombay High Court a day after the Apex Court declined to give permission to carry out the Muharram rituals throughout the country amid pandemic. The SC observed that allowing such a plea may result in targeting of a particular community for spreading COVID-19. The HC on Friday allowed the carrying of one Taziya as part of the procession which would be carried out within an hour period in a limited area with the participation of only 5 persons.

The Bombay HC placed a number of restrictions while granting permission for the Muharram rituals. There will be only 1 Taziya, and it will be carried from Zainabia (Bhendi Bazar) Mumbai to Byculla Mazgaon, Shia Cemetery, Mumbai. The Taziya is to be carried on a truck, large enough to accommodate it. There will be no gatherings, though the carrying of 1 Taziya for the entire state has been granted. The Taziya will be carried on the prescribed route on 30th August, Sunday from 4:30 to 5:30 pm.  Not more than 5 people along with a videographer are allowed in the procession. The names, age and address of these 5 persons is to be submitted in the office of Commissioner of Police, Mumbai by 5 pm tomorrow.
